Terms and Conditions of Use
Article 1 - Purpose
The purpose of the present General Terms of Use (known as the "GTU") is to provide a legal framework for the terms and conditions of availability of the https://www.amplitude-oart.com website and the services provided by AMPLITUDE SAS, and to define the conditions of access and use of the services by the website User.
The present GTU are accessible on the site under the heading "General Terms of Use".
The Publisher reserves the right to modify the GTU at any time by publishing a new version of them on the website.
The use of the website implies the acceptance, by the User, of the entirety of the present GTU. They constitute the rules governing the relationship between the website and the User. In case of non-acceptance of the general terms of use, the User must renounce access to the services offered by the website.
Acceptance of these Terms and Conditions of Use implies that Users have the legal capacity to do so.
Article 2 - Definitions
In these GTU, the following terms are defined as follows:

- "User": this term refers to any person who uses the above-mentioned web site

Article 4 - Access to the Site
The website allows the User free access to the following services:
- Product documentation
- Buy products via a personal account (login and passwords strictly confidential). To use this service, the user also accepts the Terms and Conditions of Sale when placing an order.
The Application is free of charge to Users. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are at its expense. Amplitude's responsibilities and guarantees regarding access to the services are detailed in Article 8.

Article 5 - Obligations of the User
In addition to the obligations cited in these GTU, the User agrees to comply with the following obligations:
1. The User acknowledges that he or she is aware of the characteristics and constraints, particularly technical, of the Site.
2. The User is informed and accepts that part of the Services requires him/her to be connected to the Internet and that the quality of these services depends directly on this connection.
3. The User undertakes to use the Site on a strictly individual basis. Consequently, he shall refrain from assigning, conceding or transferring all or part of his rights or obligations hereunder to a third party in any manner whatsoever.
4. The User undertakes to provide the Publisher with all the information necessary for the proper execution of the Services.
5. The User undertakes to comply with the recommendations for use described below and to implement all necessary measures to ensure data security. If need be, the Editor cannot be held responsible in case of disputes with the patient.
Article 6 - Recommendations for use
The User undertakes to take into account the following recommendations for use:
In order to ensure the confidentiality of data, the User must lock his session after using the Site. The usual recommendations concerning passwords (robustness, regular change and not communication to third parties) must be applied.
Article 7 - Prohibited uses
It is strictly forbidden to use the Application for the following purposes:
1. Any intrusion by a third party or any activity that could harm, control, interfere with, or intercept all or part of the computer system, violate its integrity or security.
2. Any practices diverting the Services for purposes other than those for which they were designed and which are listed in Article 4 - Access to the Services.
3. Copying and/or hijacking of the concept, technologies or any other element of the User's Editor Application for their personal purposes or those of third parties.
4. Any behavior likely to interrupt, suspend, slow down or prevent the continuity of the Services.
5. Any intrusion or attempted intrusion into Amplitude's systems.
6. Any breach of security and authentication measures.
7. Any acts that could harm the financial, commercial or moral rights and interests of the Publisher or Users.
8. Any actions aimed at monetizing, selling or conceding all or part of the access to the Services or the Application, as well as to the information hosted and/or shared therein.
9. And finally, more generally, any breach of these terms and conditions.
Article 8 - Responsibilities and guarantees of Amplitude
1. Amplitude undertakes to provide the site diligently and according to the rules of art, it being specified that it has an obligation of means, to the exclusion of any obligation of result, which Users expressly acknowledge and accept.
2. The information provided is presented for information and general purposes, without contractual value. Despite regular updates, the site cannot be held responsible for changes in administrative and legal provisions occurring after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information contained in this site.
3. Amplitude undertakes to carry out regular checks in order to verify the functioning of the Services. In this respect, Amplitude reserves the right to temporarily interrupt access to the Services for maintenance reasons. Likewise, Amplitude cannot be held responsible for momentary difficulties or impossibilities of access to the Application due to circumstances beyond its control, force majeure, or due to disruptions in the telecommunications networks.
4. Amplitude does not guarantee to Users (a) that the Services, which are subject to constant research to improve their performance and progress, will be completely free of errors, defects or faults, (b) that the Services, being standard and in no way offered solely for the benefit of a given User according to his or her own personal constraints, will specifically meet his or her needs and expectations.
5. The access to the services of the site may at any time be subject to interruption, suspension, modification without notice for maintenance or for any other case, at the sole discretion of the Editor.
6. Any liability is excluded in case of misuse, negligence or lack of maintenance on the part of the User, as in cases of force majeure. The Publisher's liability can only be engaged in case of proven fault or negligence and is limited to direct damages to the exclusion of any indirect damages of any kind.
Article 9 - Intellectual property
The brands, logos, signs and any other content of the site (text, images, sound...) are protected by the Code of intellectual property and copyright.
The use of the site does not confer any right to the User on the elements protected by copyright.
The User must request prior authorization from the site for any reproduction, publication, copy of the various contents. He or she undertakes to use the contents of the site in a strictly private context. Any use for commercial and advertising purposes is strictly forbidden.
Any partial representation of this site by any process whatsoever, without the express permission of the operator of the website, would constitute an infringement punishable by Article L335-2 and following of the Intellectual Property Code.
It is recalled in accordance with article L122-5 of the aforementioned code that the User who reproduces copies or publishes the protected content must cite the author of its source.
